By using Ignyte.so (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you accept these Terms and agree to comply with them.
2. Service Description
Ignyte.so provides tools for:
- Creating and managing surveys (PMF surveys)
- Embedding surveys in applications via SDK
- Collecting and analyzing survey responses
- Tracking user engagement metrics
The Service is currently in beta and provided free of charge. Features may change, and the Service may be discontinued at any time with reasonable notice.
No SLA: We do not guarantee uptime, availability, or performance levels during the beta period.
3. Eligibility
You must be at least 18 years old to use the Service.
Business Use: This Service is intended primarily for business and commercial purposes. Consumer protection laws may apply.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- Notify Ignyte immediately of any unauthorized use of your account
5. User Conduct
You agree not to:
- Violate any applicable law or regulation
- Infringe on the rights of others
- Use the Service for illegal, harmful, or malicious purposes
- Attempt to interfere with or damage the Service
6. Data Privacy
Your use of the Service is governed by our Privacy Policy.
Your Responsibilities as Data Controller: If you collect end-user data via our SDK, you are the data controller and must have a lawful basis for collection, provide appropriate privacy notices, and respond to data subject requests.
7. Disclaimers and Limitation of Liability
The Service is provided "as-is" without warranties of any kind, express or implied.
Beta Service Disclaimer:
As a free beta service operated by a private individual, the Service is provided for testing and evaluation purposes. Features may be incomplete, contain bugs, or change without notice. We recommend maintaining independent backups of critical data.
Liability Limitation under German Law (BGB §276, §309):
- Liability for intentional misconduct and gross negligence remains unlimited
- Liability for slight negligence is excluded, except for breaches of fundamental contractual obligations
- Liability for personal injury or death remains unlimited as required by law
- GDPR liability (Article 82) cannot be excluded
8. Indemnification
You agree to indemnify and hold harmless Dominik Hess and Ignyte.so from any third-party claims arising from your use of the Service, violation of these Terms, or violation of applicable laws.
9. Termination
- Ignyte.so may suspend or terminate your access at any time for violation of these Terms
- Upon termination, your right to use the Service immediately ceases
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is the court competent for the location of the service provider in Germany.
11. Changes to Terms
Ignyte.so may update these Terms at any time. Updated Terms will be posted on the website. Continued use constitutes acceptance.
12. Intellectual Property
All content, features, and functionality of the Service are owned by Dominik Hess and protected by copyright, trademark, and other intellectual property laws.
You retain ownership of all survey data and content you create using the Service.
